1. Acceptance of these terms
These Terms of Use ("Terms") are an agreement between you and Miguel Cozaín ("we", "us"), the developer of the SonoLab iPhone app ("SonoLab", "the app"). By downloading, installing or using SonoLab you accept these Terms. If you do not accept them, do not use the app.
2. Your licence to use SonoLab
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use SonoLab on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service and Apple's Licensed Application End User License Agreement.
You may not:
- copy, modify, translate or create derivative works of the app, except as permitted by law;
- reverse-engineer, decompile or disassemble it, except to the extent that this restriction is prohibited by applicable law;
- rent, lease, lend, sell, sublicense or redistribute it;
- remove or obscure any proprietary notices; or
- use it in a way that breaks any applicable law or regulation.
3. Measurement accuracy — read this one
SonoLab is a measurement aid, not a certified instrument. It reads the microphone built into a consumer smartphone, which is not a calibrated measurement microphone and is not type-approved to IEC 61672 Class 1 or Class 2, ANSI S1.4 or any equivalent standard.
Do not rely on SonoLab where a certified sound level meter or dosimeter is required — including regulatory or occupational-health compliance, official noise surveys, workplace exposure determinations, legal proceedings, insurance claims, medical or hearing-health decisions, or any situation where an inaccurate reading could harm someone. Use a calibrated, type-approved instrument operated by a qualified person for those purposes.
Readings can differ from a reference instrument for reasons outside our control, including:
- differences between iPhone models, microphone units and manufacturing tolerances;
- iOS audio processing, automatic gain control, and limits on the microphone's dynamic range — very quiet and very loud sound may be clipped or misreported;
- cases, screen protectors, pockets, fingers, dust or moisture obstructing the microphone;
- wind, handling noise, mounting, distance and the direction the phone faces;
- the calibration offset you set, or the absence of one.
The calibration feature adjusts the displayed level by an offset you choose. It improves agreement with your reference at the moment you set it; it does not make your phone a certified instrument and does not guarantee accuracy at other levels, frequencies or conditions. Exposure calculations (dose, TWA, safe time) are only as good as the levels they are computed from, and depend on the standard you select and on the app running uninterrupted for the whole period.
4. Not professional advice
Nothing in SonoLab or on this website is occupational-health, medical, engineering, acoustical or legal advice. The reference material in the app — including the descriptions of OSHA, NIOSH and NOM-011 criteria — is provided for general information, may be simplified, and may not reflect the current text of any standard or the rules that apply where you are. Consult a qualified professional and the authoritative text of the applicable standard before making decisions about noise exposure, hearing protection or compliance.
5. Responsible use
You agree that you are responsible for how you use the app, and specifically that you will:
- not use it while driving or doing anything else that requires your attention;
- not enter a hazardous environment, or stay in one, because the app suggests it is acceptable;
- wear the hearing protection required by your workplace regardless of what the app shows;
- comply with the laws where you are, including any rules about using a microphone in a workplace or in private spaces, and any workplace policy about phones; and
- not present SonoLab readings as certified measurements to third parties.
6. Your content and data
Session names, saved sessions, spectrum captures and exported reports are yours. They are stored on your device and, if you use iCloud, in your own private iCloud account — we hold no copy and cannot recover anything for you. Keeping backups is your responsibility. How the app handles data is described in the Privacy Policy, which forms part of these Terms.
7. Availability and changes
We may add, change, suspend or remove features, or discontinue SonoLab entirely, at any time and without notice. The app requires a supported iPhone and iOS version; support for older versions may end. Some functionality depends on services provided by Apple, such as iCloud, and may be unavailable if those services are.
8. Price and purchases
SonoLab is currently offered without in-app purchases or subscriptions. If paid features are introduced in future, they will be presented clearly before purchase and billed by Apple under the App Store's terms. Refunds for App Store purchases are handled by Apple, not by us, under Apple's refund policy.
9. Intellectual property
SonoLab, its name, its icon, its interface design, its text and its source code are owned by us and protected by copyright and other laws. These Terms grant you a licence to use the app, not any ownership of it. Standard names such as OSHA, NIOSH and NOM-011 belong to the bodies that issue them and are referred to here descriptively; those bodies do not sponsor, endorse or certify this app.
10. No warranty
SonoLab is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that its measurements will be accurate, complete or suitable for any particular purpose. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you; where a warranty cannot be excluded, it is limited to the shortest period the law allows.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or for hearing damage, personal injury, regulatory penalties or business losses, arising out of or connected with your use of — or inability to use — SonoLab, or your reliance on any measurement it produces. Our total aggregate liability arising out of or relating to the app or these Terms is limited to the greater of the amount you paid for SonoLab in the twelve months before the claim, or US $10.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
12. Termination
These Terms apply for as long as you use the app. Your licence ends automatically if you break them, and you can end it at any time by deleting SonoLab from your devices. Sections 3, 4, 6 and 9 to 14 survive termination.
13. Apple-specific terms
- These Terms are between you and us only, not with Apple. Apple is not responsible for SonoLab or its contents.
- Apple has no obligation to provide any maintenance or support for SonoLab.
- If SonoLab fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claim by you or a third party relating to SonoLab, including product liability claims, claims that it fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- Apple is not responsible for investigating, defending, settling or discharging any third-party claim that SonoLab infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
14. Governing law
These Terms are governed by the laws of the United Mexican States, without regard to conflict-of-law rules, and any dispute will be subject to the courts of Mexico City — except where the mandatory consumer protection law of your country of residence gives you the right to bring proceedings, or requires a different law to apply, in which case that law and those rights are unaffected.
15. Changes to these terms
We may update these Terms as the app changes. The current version always lives on this page with its date at the top. Continuing to use SonoLab after an update means you accept the revised Terms; if you do not, delete the app.
